Terms of Service

1. Acceptance of Terms

By accessing or using VIN Report (“the Service”), operated by KHouse Holdings LLC (“we,” “us,” or “the Company”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. For paid features, you will be asked to confirm acceptance before completing your purchase.

2. Service Description

VIN Report provides vehicle information reports by aggregating publicly available data from United States federal government databases. The Service offers:

• Free Reports: VIN decoding, vehicle specifications, NCAP safety ratings, safety recalls, consumer complaints, and EPA fuel economy data.
• Paid Title Reports ($4.99 per VIN): NMVTIS (National Motor Vehicle Title Information System) title history including title brands, salvage/junk records, flood damage, odometer readings, and theft recovery records, provided via VinAudit, an approved NMVTIS consumer access provider.

3. Data Source Disclaimer

All vehicle data is sourced from the following federal databases and third-party providers:

• NHTSA (National Highway Traffic Safety Administration) — VIN decoding, safety ratings, recalls, complaints
• EPA / DOE FuelEconomy.gov — fuel economy and emissions data
• NMVTIS (via VinAudit) — title history, operated by AAMVA under the U.S. Department of Justice
• NICB (National Insurance Crime Bureau) — theft and salvage records

Data is provided “as is” without warranty of any kind. Data may be incomplete, delayed, or contain inaccuracies. Government databases may experience downtime or maintenance windows. We do not guarantee the accuracy, completeness, or timeliness of any information provided.

4. Vehicle Data Limitations

A VIN Report is NOT a substitute for a professional vehicle inspection. The information provided:

• Does not guarantee the condition, safety, or value of any vehicle
• May not include all title events, especially from states with delayed reporting
• Does not include private-party accident history, service records, or odometer readings beyond what is reported to NMVTIS
• Recall and complaint data applies to the model year and may not reflect the specific condition of an individual vehicle
• Should not be the sole basis for any vehicle purchase, sale, or financing decision

5. Prohibited Uses

You agree NOT to use the Service for:

• Any purpose covered by the Fair Credit Reporting Act (FCRA), including employment screening, tenant screening, credit decisions, or insurance underwriting
• Automated scraping, bulk data collection, or systematic downloading of reports
• Reselling, redistributing, or commercially licensing report data
• Any unlawful purpose or in violation of any applicable law or regulation
• Stalking, harassment, or tracking individuals through vehicle information

6. Payment Terms

Paid NMVTIS Title Reports are priced at $4.99 per VIN as a one-time purchase. Payments are processed securely by Stripe. We do not store your credit card information. By completing a purchase, you authorize the charge and acknowledge that the report will be generated immediately upon payment confirmation.

7. Refund Policy

We offer a full refund of $4.99 if the NMVTIS title report returns no data for your VIN (some very new or imported vehicles may not have NMVTIS records). To request a refund, contact us at scott@bluewatervision.net within 24 hours of purchase with your VIN and Stripe receipt.

Refunds are not available for reports that return data you disagree with, find incomplete, or consider insufficient. The data we provide comes directly from NMVTIS and we cannot alter or supplement it. See our full Refund Policy.

8. User Responsibility

You acknowledge and agree that:

• You will independently verify vehicle information through your state DMV or relevant authority
• You will obtain a professional mechanical inspection before purchasing any vehicle
• You understand that no vehicle history report can guarantee a complete record
• Any decisions made based on report data are your sole responsibility

9. Age Requirement

You must be at least 18 years of age to use the Service. By using the Service, you represent that you are at least 18 years old.

10. Intellectual Property

The VIN Report service, including its design, code, and user interface, is the property of KHouse Holdings LLC. Government data sourced from NHTSA, EPA, NMVTIS, and NICB is in the public domain and is not owned by us. CarFax, AutoCheck, and VinAudit are registered trademarks of their respective owners and are not affiliated with this Service.

11. Third-Party Services

The Service relies on the following third-party providers:

• Stripe — payment processing (subject to Stripe's Terms of Service)
• VinAudit — NMVTIS consumer access provider
• NICB — theft and salvage database
• Cloudflare — hosting and content delivery

We are not responsible for the availability, accuracy, or terms of any third-party service.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KHOUSE HOLDINGS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM VEHICLE PURCHASE DECISIONS, INACCURATE DATA, OR SERVICE INTERRUPTIONS.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $4.99, whichever is greater.

13. Modifications

We may update these Terms at any time. Changes take effect when posted. Continued use of the Service after changes constitutes acceptance. For paid services, material changes will be noted at checkout.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of North Carolina. Before initiating any formal proceeding, you agree to contact us at scott@bluewatervision.net to attempt informal resolution. Any disputes that cannot be resolved informally shall be subject to mediation, and if necessary, binding arbitration in Pender County, North Carolina. Either party may bring claims in small claims court if eligible.
